In Matter of Eckhardt (184 Misc. 748 [Sur Ct, Orange County 1945]), a woman, who was a somnambulist, killed her husband. She was acquitted on the grounds that she did not know the nature and quality of her act. The court reasoned that the wife was not profiting from her own wrong since she had not done anything "legally wrong."
