Matter of Heinlein v. Heinlein

In Matter of Heinlein v. Heinlein (165 Misc.2d 357, 629 N.Y.S.2d 679), the Family Court decided that it would entertain objections to a temporary order of support made by a Hearing Examiner where that order did not conform to the requirements of the Child Support Standards Act. The Court stated that by declining to address the objections, the children would be receiving inadequate support during the pendency of the proceeding and the respondent might be faced with a large amount of retroactive support in the event that the final support order exceeded the amount of the temporary order.
