Matter of Long Island Pine Barrens Society, inc. v. Town of Islip

In Matter of Long Island Pine Barrens Society, inc. v. Town of Islip, 261 A.D.2d 474, 690 N.Y.S.2d 95, petitioners had alleged that they had experienced a problem of rust in their drinking water and that the Suffolk County Water Authority had performed tests on the 88-acre site to determine if wells on that property could serve as a replacement water source. Based on these allegations, the Court found that petitioners had made more than "generalized allegations that the sale will have a 'deleterious impact' on their water supply." ( Matter of Long Island Pine Barrens Society v. Town of Islip, 261 A.D.2d 474, 475, 690 N.Y.S.2d 95).
