Matter of Reinaldo O

In Matter of Reinaldo O. (250 AD2d 502 [1st Dept 1998], lv denied 92 NY2d 809 [1998] the Court found legally sufficient the trial court's juvenile delinquency adjudication determining the juvenile had committed acts constituting the crimes of grand larceny and criminal possession of stolen property. The evidence indicated the juvenile briefly acquired his teacher's credit card, copied the number and then used the card to make an unauthorized purchase. The Court found this evidence was sufficient to demonstrate the juvenile intended to acquire "the major portion of its economic value or benefit" of the card because the credit card number "permits the thief to make purchases such as phone and mail orders, up to the credit limit."
