Matter of Rogers

In Matter of Rogers, 194 Misc 2d 103, [Elmira City Ct 2002] the court clearly applied the jurisdictional constraints imposed by CPL 20.50: "Where a county contains multiple different local criminal courts, section 20.50 of the Criminal Procedure Law sets the geographical jurisdiction of offenses, and the jurisdiction of the cities, towns and villages located therein." (Matter of Rogers, 194 Misc 2d at 104, 754 NYS2d at 137.) The Rogers court held that "the receiving Probation Department, in making its recommendation as to the appropriate local criminal court to receive the case, must take into consideration the geographical residence of the defendant and the geographical jurisdiction of the local criminal court." (id. at 105.)
