Matter of Santiago v. Bristol

In Matter of Santiago v. Bristol, 273 A.D.2d 813 (4th Dept. 2000), Fourth Department found that the County Court acted in excess of its authority by allowing, over objection of defendant and the prosecutor, representatives of the broadcast and print media to intervene in a capital murder trial by obtaining an order permitting audiovisual coverage of the trial, since they had no constitutional or statutory right to broadcast the trial. The Court further stated that the proper approach was for the media to commence a declaratory judgment action in Supreme Court challenging the constitutionality of the statute and the rule barring such coverage. As a result, the Court granted a writ of prohibition to the capital defendant.
