In Matter of Sauer (194 Misc. 2d 634 [2002]) the Court addressed the question of whether a life tenant can sell the residence over the objection of remaindermen. The court concluded that the life tenant could do so based upon a finding that the application was both expedient and would carry out the provisions of the Will.
