Matter of Twin Elm Management Corp. v. Banks

In Matter of Twin Elm Management Corp. v. Banks, 181 Misc. 96 (Mun. Ct., Queens Co., 1943) the landlord sought to terminate a tenancy on the ground of nuisance, the nuisance consisting of the tenant's daughter allegedly practicing the piano twelve hours a day. The court dismissed the petition, finding that the piano-playing was not exceptionally loud or noisy, and that the piano was not used at unreasonable hours.
