In Matter of Werner (248 AD2d 907 [3d Dept. 1998]), the court found that an attempt to enforce a decree 42 years after it was entered was untimely and that the protracted and unexplained delay and the ensuing death of both parties made it impossible to establish critical facts such as to what extent payments under the divorce judgment were made.
