Matter of Young v. Jebbett

In Matter of Young v. Jebbett (213 App Div 774, 211 NYS 61 [4th Dept 1925]), the Appellate Division observed that "the fundamental rule is that all who are entitled to take part in an election shall be treated with fairness and good faith" and "that rule . . . permits the correction of a mere mistake." (Id. at 779.) However, the Court made clear that a mere mistake can be corrected only "when it can be made without prejudice to the rights of others, and before the final vote is announced." (Id.)
