Matter of Zuracino

In Matter of Zuracino. (148 Misc. 2d 707, 561 N.Y.S.2d 397 [Sur Ct. Nassau County 1990]), the Court held that although the three attesting witnesses to the decedent's last will and testament merely printed their name on the attestation portion of the will and then signed the self-proving affidavit simultaneously with the signing of the will, the will was considered validly executed under EPTL 3-2.1. Also in Zuracino, the self-proving affidavit was attached to the will under the same will back, and the court acknowledged that this intention to keep the documents together showed that the self-proving affidavit was as much part of the will as was the attestation clause.
