Mercado v. Board of Educ

In Mercado v. Board of Educ., 168 A.D.2d 611 (2d Dept. 1990) "while grasping the handrail, she plaintiff was pushed by a student or students who passed her, causing her to fall and to injure her knee." Under the circumstances, the Court held that there was no basis upon which to find the school liable, reiterating that it "has long been held that a Board of Education is not an insurer of the safety of its students."
