Miccoli v. Kotz

In Miccoli v. Kotz, 278 A.D.2d 460, the plaintiff alleges that she tripped and fell while leaving the defendant's home. There, the plaintiff alleged that she could not see the landing or a dark mat because of a lack of lighting, and because of the lack of lighting she tripped over the dark mat. The granting of defendant's motion for summary judgment was reversed, as defendant provided no competent evidence to rebut plaintiff's testimony.
