Nicholson v. Pfizer

In Nicholson v. Pfizer (278 AD2d 143 [1st Dept 2000]), involving a nonresident plaintiff claiming that he was harmed through the usage of Viagra, the Appellate Division held that defendant established its entitlement to dismissal of the action on forum non conveniens grounds, because plaintiff was a nonresident whose treating physicians were located in New Jersey, beyond the reach of New York's subpoena power.
