Pallette Stone Corp. v. State of New York Office of General Services

In Pallette Stone Corp. v. State of New York Office of General Services (168 Misc 2d 869), the court set forth the conditions upon which the State may obtain price reductions through postbid events, as follows: "the record contains no suggestion of favoritism, fraud or corruption; the public interest is advanced through the reduction in cost; and, there is no departure from the contract's original specifications and no concessions made to the contractor reducing the price" (id. at 872). In that case, the court found that the respondent's interpretation of the statute in question was rational and, therefore, concluded that it was required to "defer to a rational interpretation of a statute given by the agency charged with administering it" (id.).
