Pamac Realty Corp. v. Bush

In Pamac Realty Corp. v. Bush, 101 Misc. 2d 101 (Civ. Ct., N.Y., Co., 1979), the court held insufficient to make out a case of nuisance the allegation that the tenant had negligently set a mattress on fire with a cigarette. "If a single unintentional act were sufficient to evict a person from his home, a leasehold would be a worthless possession indeed." (At 102).
