Peo. ex. rel. I. v. Convent of Sisters of Mercy

In Peo. ex. rel. I. v. Convent of Sisters of Mercy, 200 Misc. 115, [Sup. Ct. Kings 1951]] denied an agency's writ of habeas corpus to regain custody of a five year old for placement with a maternal aunt, where the child had been placed at birth in a preadoptive foster home. The court observed: "Dr. Reder, a competent psychiatrist, whose testimony is completely credited by the Court, testified that in his opinion the uprooting of this infant from the place she calls home and away from a family she believes hers, would have a permanent deleterious psychological effect. It was his opinion, which the court accepts, that the mental trauma accompanying this separation would cause a harmful result from which she would never fully recover."
