People ex rel. Maxian v. Brown

In People ex rel. Maxian v. Brown (77 NY2d 422 [1991]), the Court of Appeals interpreted the statute to require "that a prearraignment detention not be prolonged beyond a time reasonably necessary to accomplish the tasks [recording, fingerprinting, etc.] required to bring an arrestee to arraignment." Relying on the findings of the trial court, the Court of Appeals agreed that in a large urban area, such as New York City, the necessary preliminaries can be concluded within 24 hours and that a period of delay beyond that, unless justified with a reasonable explanation, is presumptively "unnecessary" and in violation of the statute.
