In People v. Bezer, NYLJ, (Nov. 8, 1991) the warnings were read to the defendant more than two hours after his arrest. While the two-hour limit would not apply where a defendant consented to take the test, the consequences of a refusal were no longer possible. Thus, consent induced by misrepresenting the consequences of refusing to take the test was not a valid consent.
