In People v. Broadie (37 N.Y.2d 100 [1975]), where the Court of Appeals rejected the defendants' constitutional challenge to the sentencing provisions of the Rockefeller Drug Law, the Court left no doubt that a sentence that is grossly disproportionate to the crime may violate the cruel and unusual punishment clause of the United States Constitution.
