People v. Christiano

In People v. Christiano (53 Misc 2d 433 [Westchester County Ct 1967]), the defendant was charged with driving while intoxicated and vehicular homicide. The victim was injured in an accident with defendant and died 17 days later. The court held that defendant was entitled to discovery and inspection of the decedent's medical records. The court also noted that the defendant, in the interests of justice and to avoid delay at the trial, should be given the opportunity to examine the evidence where it is of such a nature as to require lengthy examination by experts to determine whether it is favorable to the defendant.
