In People v. Cordeiro (18 Misc 3d 1135[A] 2008 NY Slip Op 50320[U] [Webster Just Ct 2008]) the Court found the accusatory instruments charging the defendant with common-law and aggravated driving while intoxicated insufficient when neither the Alcohol/Drug Influence Report nor the addendum were incorporated by reference into the supporting deposition or verified in accordance with CPL 100.30 (1) (d).
