In People v. Flayhart (72 N.Y.2d 737 [1988]), a husband and wife were found guilty of criminal homicide of the husband's brother, who "was mentally retarded and afflicted with a number of ailments," when he "died of neglect while he was living in their home and was totally dependent upon their care" (see id., at 740).
