People v. Gipson

In People v. Gipson, 256 A.D.2d 718, it was recognized that the person on probation is responsible to pay the fees for his treatment. Gipson's probationary sentence was revoked and he was sentenced to an indeterminate term of imprisonment because of his failure to report for a substance abuse evaluation. Gipson's excuse was that he could not afford to pay the $ 30.00 fee. The Court held that Gipson's representations that he found it impossible to afford the evaluation fee of $ 30.00 between the time of his release on probation in December 1995 and the time of his arraignment in May 1997, even after he had found employment, were too frivolous to even merit discussion.
