People v. Golon

In People v. Golon. 174 AD2d 630 (2nd Dept 1991) the defendant was indicted for Grand Larceny and related offenses in connection with a certain automobile. The prosecutor was in possession of evidence, including a Certificate of Title, indicating that the defendant was the true owner of the vehicle he was alleged to have stolen. The prosecutor did not, however, present any of it to the Grand Jury. The court held it improper for the People to withhold such evidence which "went to the very heart of the charge" and "would have materially influenced the Grand Jury's investigation and findings." Id., at 632.
