People v. Gooden

In People v. Gooden, 111 A.D.2d 871 (2d Dept. 1985) the officer more precisely described the excessive speed of the vehicle by testifying that it was traveling at a speed at 50 to 60 miles per hour. In addition, although the officer was then on anti-crime duty, his experience in assessing the speed of moving vehicles was demonstrated by foundational testimony that he had issued some 50 speeding tickets during his nine years on the force. While not dispositive, the credibility of the officer's claim of excessive speed in Gooden was also enhanced by his issuance of a speeding ticket for the violation.
