People v. Johnson

In People v. Johnson, 54 AD3d 636, 863 N.Y.S.2d 680, 2008 NY Slip Op 7074 (1st Dep't 2008), the trial court was held to have properly declined to dismiss an indictment on the ground that a prosecution witness revealed at trial that a portion of his grand jury testimony was untrue, where the indictment was amply supported by other evidence, and there was no suggestion that the prosecutor had reason to believe the testimony was false.
