People v. Knowles

In People v. Knowles, 244 AD2d 425 (1997), prior to the imposition of sentence, the defendant was given an opportunity to explain her earlier initial failure to appear and her failure to register for a drug treatment program. The defendant was unable to give a plausible explanation. The reviewing court held that "contrary to the defendant's contention, the court did not err in declining to hold a hearing ... (see, CPL 400.10), and properly imposed a sentence of incarceration" (Knowles, 244 AD2d 425, 426.)
