People v. Motley

In People v. Motley, 69 N.Y.2d 870 (1987) two defendants each pled guilty to attempted Promoting Prison Contraband in the First Degree in satisfaction of an indictment that charged them with the completed crime. Upholding the defendants' convictions, the Court of Appeals held that although "the statute defining the crime charged ... did not define dangerous contraband," the reference in the indictment to the statute defining the crime charged constituted allegations of not only "the elements of the crime," but also "their statutory definitions."
