People v. Park

In People v. Park, 229 A.D.2d 598 (2d Dept. 1999), the defendant's conviction was vacated and this case was remitted for a new trial. In Park, the defendant's attorney failed to present witnesses at trial who would have supported the defendant's alibi. In addition, the attorney failed to present witnesses and other evidence which indicated that the defendant suffered injury as a result of a recent accident that would have shown it was unlikely he committed the crime. The Park court found that while there may have been a valid strategy for failing to present an alibi defense, the cumulative effect of the attorney's errors warranted reversal.
