People v. Parrett

In People v. Parrett, (90 Misc 2d 541, 394 N.Y.S.2d 809 [Dist Ct Nassau Co 1977] the defendant was stopped at the top of an escalator after allegedly being observed placing two items in her handbag on the main floor of the store. The court held that until a defendant left the premises there was no proof that the defendant committed larceny, since there was no proof that defendant intended to deprive the owner of the property. (Id at 543).
