People v. Pelose

In People v. Pelose (116 Misc 2d 788) the defendant was charged with Usury in the First Degree. The prosecution requested permission to introduce at trial evidence of the defendant's prior crimes of usury. The trial court ruled that such evidence was relevant on the element of "scheme or business of making or collecting usurious loans" (788). After the court so ruled, the defendant offered to "stipulate" to this element. The People refused to stipulate (789).
