In People vs. Prado 2 Misc. 3d 1002[A] 2004 NY Slip Op 50082[U] (Supreme Court, New York County, 2004) the issue was whether there was probable cause to stop the vehicle for which the occupants were subsequently indicted for " possession of a controlled substance degree" The Court after the suppression hearing suppressed any evidence resulting from the traffic stop when the testifying officer "demonstrated no evidence of background of estimating speeds".
