People v. Scott D

In People v. Scott D. (34 N.Y.2d 483) the Court of Appeals suppressed drugs recovered from a student who had been under observation by school officials for six months, after being informed that he was a drug dealer. The Court found that the observations leading to the search were consistent with innocent behavior, but acknowledged that continued observation of the student would have been warranted. Inherent in this ruling is the recognition that school officials were dealing with an ongoing situation that lent itself to further investigation.
