People v. Shinkle

In People v. Shinkle (51 NY2d 417 [1980]), it was held that the fact that the attorney who initially represented defendant and participated actively in the preparation of his defense became the Chief Assistant in the prosecutor's office in the months before and during the trial should have resulted in the disqualification of the prosecutor's office. While no actual prejudice was shown, there was an appearance of impropriety and a continuing opportunity for abuse of confidences entrusted to the attorney by the defendant (People v. Shinkle, 51 NY2d at 420-421).
