People v. Stroman

In People v. Stroman (36 NY2d 939 [1975]) the defendant had not been present in the courtroom when the sentence was pronounced, as required by CPL 380.40 (1), and was deprived of his statutory right to make a statement pursuant to CPL 380.50. (People v. Stroman, 36 NY2d at 940.) These procedural errors required remitting the case to the sentencing court for full resentencing. (Id.)
