People v. Town of Clarkstown

In People v. Town of Clarkstown (160 A.D.2d 17, 559 N.Y.S.2d 736 [2d Dept 1990]) the Appellate Division, Second Department held that the State had preempted this field by enacting Social Services Law 390 , recognizing "that because of the economic stresses placed on families, especially mothers, the need for child care is increasing" (id. at 22) and that it was necessary for mothers to work in order to maintain an adequate standard of living or simply to escape poverty.
