People v. Valencia

In People v. Valencia, 3 NY3d 714 [2004] the defendant argued that when an issue is raised as to an alleged violation of a plea agreement, due process requires an evidentiary hearing and finding by a preponderance of the evidence that the defendant violated the plea agreement before sentencing the defendant to prison. Reasoning that "here, defendant does not dispute that he committed acts that constituted violations of the plea agreement" (id. at 715), the Court of Appeals held that the sentencing court made a sufficient inquiry to satisfy due process.
