People v. Vasquez

In People v. Vasquez, 108 A.D.2d 701 [1985], the police detained the defendant, and seized a weapon from him, believing him to be the subject of an active warrant. The court held that even though additional investigation confirmed that the individual taken into custody was not the subject of the arrest warrant, evidence seized from him pursuant to the warrant did not have to be suppressed since the police maintained a reasonable suspicion all along.
