In People v. Washington, 19 A.D.3d 1180, 1181, 796 N.Y.S.2d 500 (4th Dept. 2005), defense counsel conceded in summation that the defendant was guilty of the lesser included charge of Robbery in the Second Degree, the same concession trial counsel made here. Echoing the words used by both the Second and Third Departments, the Fourth Department held that the concession was "a perfectly acceptable strategy," and did not deprive the defendant of effective assistance of counsel.
