In People v. Wikowski, 19 NY2d 839 (1967), the Court of Appeals analyzed a motion for a writ or error coram nobis, prior to the passage of CPL 440, wherein the defendant alleged there had been false testimony by a prosecution witness. The Court stated, the question is "...whether the prosecution knew, or had reason to know, that such testimony was false."
