In Peterson v. Spartan Industries, Inc., 33 NY2d 463 (1974), the plaintiffs produced records indicating that the defendant had stated that the New York Fire Department approved the use of its product. Further records demonstrated that the defendant had applied for several permits and received permission to sell and store some of its products in New York. Peterson, (33 NY2d at 467.)
