In Purcell v. Axelsen, 286 A.D.2d 379 (2nd Dep't 2001), the Appellate Division reversed the trial court's refusal to set aside a jury verdict of $ 0.00 for future pain and suffering where "a recent x-ray of the plaintiff's spine showed a compressed L-2 lumbar vertebra which was likely to cause early arthritis and chronic back pain."
