In Reilly v. DiGiacomo & Son, 261 A.D.2d 318 (1st Dept. 1999), summary judgment was denied on an owner's common law indemnification claim against the general contractor because the owner did not establish that the contractor was "either negligent or exclusively supervised and controlled plaintiff's work site."
