Riley v. J.A. Jones Contr., Inc

In Riley v. J.A. Jones Contr., Inc. (54 AD3d 744 [2008]) plaintiff was instructed to demolish a wall that he had just constructed, and rebuild it to meet certain specifications. Plaintiff's supervisor directed plaintiff to begin construction of the wall without allowing the scaffold to be cleared of the bricks. The Second Department held that triable issues of fact existed as to whether the brick over which the plaintiff allegedly tripped was integral to the work being performed or if it was "debris."
