Rogan v. Giannotto

In Rogan v. Giannotto, 151 A.D.2d 655 [1989], the plaintiff firefighters alleged a cause of action for common-law negligence as a consequence of the landlord's failure to maintain operable smoke detectors. The plaintiffs were injured "as they attempted to climb a scuttle ladder which led to the roof" of a building which was adjacent to the building that was burning. (Id.) The Appellate Division, Second Department, reversed the Supreme Court's denial of summary judgment, and granted the landlord's application to dismiss the complaint and all cross claims.
