Royal Globe Inc. Co. v. Mottola

In Royal Globe Inc. Co. v. Mottola, 89 A.D.2d 907, 453 N.Y.S.2d 723, Special Term granted partial summary judgment on the issue of Mottola's liability for causing fire damage to a building. The judgment was based on Mottola's guilty plea to Arson in the Fourth Degree for which he was adjudicated a youthful offender. Since County Court had not authorized the disclosure of the plea minutes, the Appellate Division reversed the judgment on the ground that it was based on an improperly disclosed record. The use of those records without a specific court order authorizing disclosure undermined the purpose of CPL 720.35.
