Sakol v. Kirsch

In Sakol v. Kirsch, 25 A.D.3d 523 (1st Dept. 2006) plaintiff fell down the stairs in a mansion on the Hudson constructed more than 100 years earlier and prior to the adoption of building codes. The court, in granting summary judgment to the defendant, found that "the affidavit of plaintiff's engineering expert was insufficient to defeat defendants' motion for summary judgment inasmuch as it failed to set forth a violation of any specific safety guidelines in effect at the time of the mansion's construction." Id.
