Schneider v. Kings Highway

In Schneider v. Kings Highway, 67 N.Y.2d 743 (1986), the elderly plaintiff fell from her hospital bed with a lowered bed rail. The hospital had a rule that the side rail be maintained at a raised position at all times for patients over 70 years old. The Court of Appeals analyzed the case as a general negligence matter and found that the plaintiff had established a prima facie case. Id.
