Schultz v. Turner Constr. Co

In Schultz v. Turner Constr. Co., 278 A.D.2d 76, 717 N.Y.S.2d 76 (1st Dept. 2000), the plaintiff suffered an injury to his knee, for which he underwent arthroscopic surgery and received physical therapy for eight months. The plaintiff's knee severely affected his ability to perform household duties, and would continue to do so for over a period of 25 years. He was further expected to undergo surgery in the future. On appeal, the First Department stated that the judgment awarding the plaintiff a principal amount of $ 200,000 and $ 400,000 for past and future pain and suffering, respectively, was not excessive.
